Portable Charger Kiosks
These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Veloxity One LLC (“Veloxity,” “we,” “us,” or “our”) governing your access to and use of Veloxity portable charger kiosks (“Kiosks”) and portable charging devices (“Chargers”).
By accessing or using a Kiosk or Charger, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Kiosk or Chargers.
1. Acceptance of Terms
You agree to these Terms by initiating use of a Charger through any available method, including but not limited to:
- Pressing a physical button on a Kiosk;
- Entering a phone number;
- Providing or using a payment method.
Such actions constitute your affirmative acceptance of these Terms.
2. Eligibility
You must be at least eighteen (18) years of age to use the Kiosks or Chargers. By using the service, you represent and warrant that you meet this requirement.
3. Description of Services
Veloxity provides temporary access to portable Chargers through self-service Kiosks located at events and venues. Chargers are provided solely for short-term, personal use and must be returned in accordance with these Terms.
4. Methods of Access
4.1 Button Access (Honor System)
Users may obtain a Charger by pressing a button on the Kiosk without providing personal information. By doing so, you agree to return the Charger promptly after use, and in all cases prior to leaving the venue or by the end of the applicable event.
4.2 Phone Number Access
Users may obtain a Charger by entering a valid mobile phone number.
By providing your phone number, you consent to receive transactional SMS communications related to your rental, including:
- A confirmation message when a Charger is dispensed; and
- A reminder message if the Charger has not been returned.
Message frequency is limited. Standard message and data rates may apply. You may opt out at any time by replying “STOP” and request assistance by replying “HELP.”
4.3 Credit Card Access
(a) Free-to-Use Model
A temporary authorization hold, typically ranging from $40 to $65, will be placed on your payment method at the time of rental. No charge will be incurred if the Charger is returned within forty-eight (48) hours. If the Charger is not returned within that timeframe, you authorize Veloxity to charge the full amount of the hold as a non-return fee.
(b) Pay-to-Use Model
Usage fees are charged in fixed hourly increments (e.g., $2 per hour), with each hour billed in full. Partial-hour usage is rounded up to the next full hour.
Charges will continue to accrue until the Charger is returned or until the maximum fee is reached. The maximum total charge, inclusive of all usage fees, will be displayed on the Kiosk and typically ranges between $40 and $65. If the Charger is not returned within forty-eight (48) hours, the maximum charge will apply.
All pricing and applicable fees are disclosed at the Kiosk prior to use.
5. Return of Chargers
You agree to return the Charger to a compatible Kiosk:
- Immediately upon completion of use; and
- In all cases, prior to leaving the venue or by the end of the event.
Failure to return a Charger may result in charges as described in Section 4.
6. Acceptable Use
You agree to use the Charger solely for its intended purpose of charging personal electronic devices. You shall not:
- Tamper with, modify, or misuse the Charger;
- Use the Charger for commercial purposes;
- Use the Charger in violation of any applicable law or regulation.
7. Charger Functionality and Limitations
You acknowledge and agree that:
- Chargers may not be compatible with all devices;
- Charging speed and performance may vary;
- Chargers may lose power or cease functioning at any time;
- Availability of Chargers is not guaranteed.
Veloxity makes no guarantees regarding performance, availability, or suitability for any particular use.
8. Assumption of Risk
Your use of the Charger is at your own risk. Chargers are electronic devices that may malfunction without warning. You assume all risks associated with their use, including any damage to your device or inconvenience resulting from performance limitations.
9. Payments and Processing
All payments are processed through Stripe or other authorized third-party providers. Veloxity does not store full payment card information.
By providing a payment method, you represent that you are authorized to use it and authorize Veloxity to charge applicable fees in accordance with these Terms.
10. Privacy Notice
10.1 Information Collected
We may collect the following information in connection with Kiosk use:
- Phone number (for SMS-based access);
- Limited transaction data (processed via third-party providers);
- Rental activity data (such as time, location, and return status);
- Partial payment identifiers (e.g., last four digits of card).
10.2 Use of Information
We use this information solely to:
- Operate and provide the service;
- Send transactional communications;
- Process payments;
- Monitor and prevent misuse;
- Improve system performance;
10.3 Data Practices
- We do not sell personal information;
- We do not use phone numbers for marketing purposes;
- We do not store full payment card details.
Third-party providers (including payment processors and messaging infrastructure providers) may process data on our behalf in accordance with their own policies.
11. Disclaimer of Warranties
The Kiosks and Chargers are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, Veloxity shall not be liable for any indirect, incidental, special, or consequential damages. Veloxity’s total liability shall not exceed the greater of:
- One hundred dollars ($100); or
- The total amount paid by you in connection with the applicable rental.
13. Limitation of Liability
You agree to defend, indemnify, and hold harmless Veloxity One LLC and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use or misuse of the Kiosks or Chargers;
- Your violation of these Terms; or
- Your violation of any applicable law or third-party rights.
14. Arbitration and Dispute Resolution
Any dispute arising out of or relating to these Terms shall be resolved through binding individual arbitration, and not in a court of law.
You waive any right to participate in class actions or jury trials. You may opt out of arbitration by contacting Veloxity within thirty (30) days of your first use.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
16. Changes to Terms
Veloxity reserves the right to modify these Terms at any time. Continued use of the service constitutes acceptance of any updated Terms.
17. Entire Agreement
These Terms constitute the entire agreement between you and Veloxity regarding your use of the Kiosks and Chargers and supersede all prior or contemporaneous communications, whether oral or written.
18. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary or deemed severed, and the remaining provisions shall remain in full force and effect.
19. Waiver
Veloxity’s failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or any other provision.
